Please thoroughly read through this agreement to understand what information Beat-Play,
L.L.C. collects about you when you use beatplay.com or apps.facebook.com/beatplayplayer,
and their associated sub-domains including but not limited to any use of any interface
Beat-Play, L.L.C. may provide for authorized external parties to interact with. The Beat-Play
Site and the respective Facebook App are hereby referred to as the "Service". If you find
any part of this policy unacceptable, please discontinue your use this site immediately, as
this Policy is integrated into, and subject to the Term of Use for the use of the Site
(Beatplay.com). The use of any or all components of this Service constitutes an agreement
between yourself and Beat-Play to knowingly accept and agree to the terms and provisions
of this privacy policy.
Definitions
User:
For the purpose of the agreement, a user shall be defined as someone who is either
directly interacting with the service.
Private information:
Data which a user has submitted to this service, or has been accumulated by this service
through its use, but is not accessible to a subset or all users (excluding the user who
originally created or submitted the data) of the Service or the general public via normal
use of this Service.
Personally identifiable information:
Data which ties a particular user's IP address, or full name (meaning both their first and
last name), with an action, for example streaming a particular song via this service. If
such information is public information, it is not considered personally identifiable
or private.
Public information:
Data which a user has submitted to this service, or has been accumulated by this service
through its use, and is available to be viewed and/or consumed by any user of this service
or a subset of the system's users, or the general public. This may include, but is not
limited to information on a user's public profile page, tags, comments, and/or ratings
submitted by a user.
Information we collect and who can access it:
Public and private information:
To provide the needed data to make this service possible, Beat-Play collects and stores
information that includes but is not limited to user information submitted during sign up,
profile information, and music library information and its accompanying information such
as tags, ratings, and comments. Beat-Play stores this information for an indefinite amount
of time. This information will not be shared with any 3rd party without consent from the
user, or unless otherwise stated in this policy or the Terms of Service.
Personally identifiable information:
When you use this service, information about your computer's request is saved by
Beat-Play. This data may include information such as IP address information. IP address
information is stored for no more that 6 months from the date the information is recorded.
This data may be stored for longer, up to an indefinite amount of time, if Beat-Play is so
ordered to do so by a United States court of law with proper jurisdiction. This may be
done without any notification to the user. This information may also be kept longer than 6
months by Beat-Play if a user is found by Beat-Play's sole judgment to be suspect of
carrying out illegal, unlawful, or dangerous actions with or in this service. Prior to
keeping IP address information for more than 6 months, the user will be notified via email
about their suspect status.
In addition to recording information involving a user's IP address as described above,
Beat-Play collects and stores personally identifiable information that includes but is not
limited to information that links music streams to particular users and information that links
users and there corresponding actions on the Site and/or Service. This information is
needed to enable certain features the service provides, and is stored for an indefinite
period of time. Private information will not be shared with any 3rd party without consent
from the user, or unless otherwise stated in this policy or the Terms of Service. You should also be aware that if you voluntarily disclose personally identifiable information
on message boards, in chat areas, or other openly viewable parts of the service, that
information can be viewed publicly and can be collected and used by third parties without
our knowledge and may result in unsolicited messages from other individuals or third
parties. Such activities are beyond the control of Beat-Play and this policy.
Anonymous information:
Beat-Play records anonymous information about users of the
service which is stored for an indefinite period of time. This information does not link any
statistic with any particular user. This data may include, but is not limited to, averages and
or totals of browser and operations system types, entry and exit pages, user, artist, or
album popularity, demographic information, and amount of data transferred. This
information may be shared with any 3rd party Beat-Play chooses at any time and for any
length of time.
Changes in Our Privacy Policy
Beat-Play reserves the right to revise/alter this agreement at any time with no notice given.
Any updates will be posted to this page, with the last updated information changed
accordingly. If we make changes, we will post them on our site to make Users aware of
what the changes are, so Users will always be aware of what information we collect, how
we use it, and when we may disclose it. A User is bound by any minor changes to the
Privacy Policy when she or he uses the site after those changes have been posted.
Privacy of Children Under the Age of 13
Beat-Play, L.L.C. does not knowingly collect or solicit Personally Identifiable Information
from or about children under 13 except as permitted by law. If we discover we have
received any information from a child under 13 in violation of this policy, we will delete
that information immediately. If you believe Beat-Play, L.L.C. has any information from or
about anyone under 13, please contact us at privacy@musicwithoutlabels.com.
Governmental Provisions
This Agreement and the relationship between you and Beat-Play shall be governed by the
laws of the State of Pennsylvania without regard to its conflict of law provisions. You and
Beat-Play agree to submit to the personal and exclusive jurisdiction of the courts
located within the State of Pennsylvania.
User Notice
You hereby indemnify and hold harmless, and upon Beat-Play's request, defend, Beat-Play,
its affiliates (and their respective directors, officers and employees) from and against any
and all losses, liabilities, damages, costs or expenses (including reasonable attorneys' fees
and costs) arising out of any external party utilizing Beat-Play in a way which violates
Beat-Play's TOS.
Protected Private Information
Your password, in any form, be it plain text or encrypted.
Your Real Name, unless already made public throughout any of the various public parts of
the site.
